Terms
Last updated October 19, 2026
These terms cover this website and the services Nightsafe Software LLC ("we", "us") provides. When we take on a project, we agree the details in writing. If that written agreement says something different from these terms, the written agreement applies.
Security has no guarantees
Good security work lowers risk. It can't remove it. Here is what that means for the work we do:
- Audits are a snapshot. A security audit reviews the systems, code and scope agreed in writing, as they were at the time of testing, within the time and access we were given. It can't find every vulnerability, and it doesn't cover changes made afterwards, newly discovered attack techniques, third-party services, or anything outside the agreed scope.
- Apps and websites we build. We build with care and follow widely used security practices, but no software is free of bugs or vulnerabilities.
- No promise against attacks. We don't guarantee that any app, website or system we build, review or test is free of vulnerabilities, or that it will not be hacked, breached or misused.
- After handover. Once work is delivered, you're responsible for operating, updating and securing your systems, including hosting, passwords and access, backups, and third-party services, unless a written support agreement says otherwise.
- Permission to test. We only test systems you own or are authorized to have tested. By asking us to test a system, you confirm you have that authority.

To the fullest extent permitted by law, Nightsafe Software LLC will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill. This includes losses caused by a security incident, data breach or attack carried out by someone else, even if we were told such losses were possible.
